I fear two possibilities; either the US will succeed in intimidating
additional members of the UN Security Council to support the US/UK resolution,
and although France, China and Russia will probably VETO the resolution, the
US will claim "a moral majority". Or the US will claim that under
UN Security Council Resolution 1441 "serious consequences" as claimed by
Powell is a code word for military invasion and thus that 1441 authorized military action.
[as you know under the Convention of the Law of Treaties, language in international law
must be interpreted in its ordinary meaning, and the ordinary meaning
of "serious consequences" is not a military invasion.
Along with many others, I am proposing a procedure that would demonstrate to the
United States that the global community as represented in the UN General Assembly
does not support the invasion of Iraq.
I urge you to request an emergency General Assembly session evoking the
1950 "Uniting for Peace" resolution under the following provision:
that if the UN Security Council fails to exercise its role under the
Charter of the United Nations--to prevent the scourge of
war-the UN General Assembly cannot absolve itself from fulfilling that role.
And “. If not in session at the time, the General Assembly may meet in emergency
special session within twenty-four hours of the request therefore.
Such emergency special session shall be called if requested by
the Security Council on the vote of any seven members, or
by a majority of the Members of the United Nations” ;(Uniting for Peace,1950)
There is no doubt that the UNGA would support, with the required 2/3 majority,
the continuation of the work of the inspectors, and would oppose a military
invasion of Iraq. A strong vote from the UNGA would demonstrate clearly
that the United States does not have the support of the UN and the
international community.
I just returned from the United Nations where I heard that the US,
aided and abetted by Canada, and Australia was intercepting
conversations of its colleagues on the Security Council.
This practice along with the cajoling, intimidating and bribing of various
members of the Security Council by the United States verges on an indictable offence.
The determination of the relevance of the United Nations depends
not on whether the US successfully undermines the principles of the
members of the Security Council but on the ability of the UN to
stand firm against US unilateralism and to strive to prevent
the scourge of war.
